ESTATE PLANNING AND PROBATE DEPARTMENT
The firm’s estate planning department is chaired by Mary M. Rudser. The department’s areas of emphasis are estate planning, trust and estate administration, and various probate matters
The firm’s estate planning practice provides comprehensive representation of clients concerning their estate planning needs, including the drafting of wills, living trusts, irrevocable life insurance trusts, special needs trusts, and succession planning for family-owned businesses. The firm also assists clients in implementing lifetime gifts and charitable donations, in planning for retirement, and in preparing for potential incapacity.
Trust and Estate Administration
Administration of trusts and estates typically arises after there has been a death. The firm works with executors and successor trustees to assemble and account for the decedent’s assets, to settle all outstanding obligations, and to distribute the assets to the beneficiaries. In particular, the firm assists executors and trustees in making timely decisions concerning estate and income taxes, funding of sub-trusts, and possible use of disclaimers.
The firm handles probates of estates of all sizes, spousal property petitions, trustees’ petitions for instructions, and a variety of other matters requiring court overview.

The commercial leasing practice ranges from the preparation of large, multi-tenant leases to preparation of individual industrial, shopping center, office and retail leases. The firm also handles all aspects of lease workouts in its real estate department, as well as commercial, live-work and commercial-residential unlawful detainers in its litigation department.
Acquisition, Development & Conservation Work
The firm assists developers and individuals with the acquisition and development of a variety of properties, ranging from large, multi-use urban properties to small, single-use buildings and land. The firm’s business formation practice includes the creation of all types of business entities, including the formation of for profit corporations, nonprofit corporations, limited liability companies and partnerships. The firm assists clients with the selection of form of entity in which to do business. The firm prepares all documentation and governmental forms necessary to complete business formation and drafts organizational and buyout agreements among business co-owners. The firm also advises its business clients regarding their general business operations and compliance with California Corporations Law.
